GENERAL TERMS AND CONDITIONS OF CONTRACT
1. Subject of the contract
1.1. These General Conditions have as their object the purchase of products and services, carried out remotely, via electronic network, by Garofalo Carmelina, C/da Pallone 87050 Marzi (CS) owner of the site www.scalzo.it Each purchase transaction will be governed by the provisions of the Legislative Decree of. 6 September 2005 n. 206 and, as regards the protection of confidentiality, it will be subject to the regulations referred to in Law no. 196/2003.
1.2. The delivery times indicated in the price list and/or confirmed by order confirmation may be subject to variations, also due to work scheduling. In any case, they are always indicative, never binding for the seller and are always intended as working days.
2. Acceptance of the general conditions of sale
2.1. The contract stipulated between the Scalzo company and the Customer must be considered concluded with the acceptance of the order by the Scalzo company. This acceptance is considered tacit if the latter company begins to execute the contract. Should the order be placed during public holidays, the Scalzo company reserves the right to accept the order within the first following working day.
2.2. The simple payment of the fee by the Customer, through an online payment process or by credit card, does not constitute completion of the contract. Therefore, in the event that the Scalzo company intends to reject the purchase proposal made by the Customer, it will be required immediately, and in any case no later than the following twenty-four working hours, to refund any advance payment.
2.3. The Customer will not be able to request any compensation for damages or compensation, nor assert any contractual or non-contractual liability, for direct or indirect damage to people and/or things, caused by the non-acceptance, even partial, of an order.
2.4. By placing an order, the Customer declares to have read all the information provided to him during the purchase procedure and to fully accept the general and payment conditions set out below.
3. Purchase Methods
3.1. The Customer can only purchase the products present on the site at the time of placing the order as described in the relevant information sheets.
3.2. The image accompanying the descriptive sheet of a product may not be perfectly representative of its characteristics, but may differ for example, by way of example but not limited to, in colour, dimensions, accessories present in the figure, etc. All information supporting the purchase is to be understood as simple generic information material, not referable to the real characteristics of a single product.
3.3. The correct receipt of the order is confirmed by L'Azienda Scalzo by means of a response via e-
In the event of non-acceptance of the order, the Scalzo company will promptly notify the Customer.
3.4. The prices in the list are valid until changes, which may occur at any time and without notice.
3.5. Payments will be made: by bank transfer (to the current account CREDITO COOPERATIVO CENTRO CALABRIA Branch of Santo Stefano di Rogliano (CS) IBAN: IT97O 08258 81140 011000004084, or by credit card, or by cash on delivery to the courier.
3.6. Shipping and delivery costs are the responsibility of the buyer.
4. Right of withdrawal
4.1. If the customer is a consumer (i.e. a natural person who purchases the goods for purposes not related to his professional activity, or does not make the purchase indicating in the order form to the Scalzo company, he has the right to withdraw from the purchase contract .
To exercise this right, the customer must send a communication to this effect to L'Azienda Scalzo within 10 working days from the date of receipt of the goods. This communication must be sent by registered letter with acknowledgment of receipt, addressed to: Garofalo Carmelina, C/da Pallone –
4.2. The right of withdrawal is however subject to the following conditions:
a) the right applies to the product purchased in its entirety; it is not possible to exercise withdrawal only on part of the purchased product;
b) the purchased good must be intact and returned in the original packaging, complete in all its parts;
c) shipping costs relating to the return of the goods are borne by the Customer;
d) the shipment, until receipt is certified in the selling company's warehouse, is under the complete responsibility of the Customer;
e) in the event of damage to the goods during transport, the Scalzo company will notify the Customer of the incident (within 5 working days of receiving the goods in its warehouses), to allow him to promptly file a complaint against the courier he has chosen and obtain reimbursement of the value of the property (if insured); in this case, the product will be made available to the Customer for its return, simultaneously canceling the withdrawal request;
f) The Scalzo company is not responsible in any way for damage or theft/loss of goods returned by uninsured shipments;
g) upon arrival at the warehouse, the product will be examined to assess any damage or tampering not resulting from transport. If the package and/or the original packaging are damaged, the Scalzo company will deduct a percentage from the refund due, in any case not exceeding 10% of the same, as a contribution to the restoration costs.
4.3. Without prejudice to any restoration costs for ascertained damage to the original packaging, the Scalzo company will reimburse the customer the amount already paid as quickly as possible and in any case within 30 days of the withdrawal request, through a cancellation procedure of the amount charged. on your credit card or by bank transfer. In the latter case, it will be the customer's responsibility to promptly provide the bank details on which to obtain the refund (IBAN or ABI code –
4.4. The right of withdrawal is totally lost, due to lack of integrity of the goods (packaging and/or its contents), in cases where the Scalzo company ascertains:
a) the lack of the external packaging and/or the original internal packaging;
b) the absence of integral elements of the product;
c) damage to the product for reasons other than its transport.
4.5. In the event of forfeiture of the right of withdrawal, the Scalzo company will return the purchased goods to the sender, charging the shipping costs to the sender.
