GENERAL TERMS OF CONTRACT

1. Subject of the contract
1.1. These General Conditions concern the purchase of products and services made remotely, via telematic network, from Garofalo Carmelina, C/da Pallone 87050 Marzi (CS), owner of the website www.scalzo.it. Each purchase transaction will be governed by the provisions of Legislative Decree no. 206 of September 6, 2005, and, regarding privacy protection, will be subject to the regulations of Law no. 196/2003.
1.2. Delivery times indicated in the price list and/or confirmed by order confirmation may vary, also due to work scheduling. In any case, they are always indicative, never binding for the seller, and are always understood as working days.

2. Acceptance of the general terms of sale
2.1. The contract concluded between the Scalzo company and the Customer is considered concluded upon acceptance of the order by Scalzo. Such acceptance is deemed tacit if the company begins to execute the contract. If the order is placed during holidays, Scalzo reserves the right to accept the order by the next working day.
2.2. The mere payment by the Customer, through online payment or credit card, does not constitute contract completion. Therefore, if Scalzo intends to refuse the purchase proposal made by the Customer, it will immediately, and in any case no later than twenty-four working hours after, refund any amount paid in advance.
2.3. The Customer cannot claim any damages or compensation, nor assert any contractual or non-contractual liability, for direct or indirect damages to persons and/or things caused by the non-acceptance, even partial, of an order.
2.4. By placing an order, the Customer declares to have read all the information provided during the purchase process and to fully accept the general and payment conditions below.

3. Purchase methods
3.1. The Customer can only purchase products available on the site at the time of order submission as described in the related product sheets.
3.2. The image accompanying the product description may not perfectly represent its characteristics, and may differ, for example and not exhaustively, in color, size, accessories shown, etc. All purchase support information is to be considered as general informational material, not referring to the actual characteristics of a single product.
3.3. Correct receipt of the order is confirmed by Scalzo via email sent to the email address provided by the Customer. This confirmation message will include an Order Number to be used in all further communications with Scalzo. The message repeats all data entered by the Customer, who commits to verify its accuracy and promptly communicate any corrections as described in this document.
In case of non-acceptance of the order, Scalzo will promptly notify the Customer.
3.4. Price list prices are valid until changes, which may occur at any time without notice.
3.5. Payments will be made by bank transfer (to the CREDITO COOPERATIVO CENTRO CALABRIA account, Santo Stefano di Rogliano (CS) branch, IBAN: IT97O 08258 81140 011000004084), or by credit card, or cash on delivery to the courier.
3.6. Shipping and delivery costs are borne by the buyer.

4. Right of withdrawal
4.1. If the customer is a consumer (i.e., a natural person purchasing goods for purposes not related to their professional activity, or not making the purchase indicating so in the order form to Scalzo), they have the right to withdraw from the purchase contract.
To exercise this right, the customer must send Scalzo a communication to that effect within 10 working days from the date of receipt of the goods. This communication must be sent by registered letter with return receipt to: Garofalo Carmelina, C/da Pallone – 87050 Marzi (CS), or by telegram or fax sent within the 10-day term and followed by confirmation by registered letter with return receipt sent within 48 hours. Upon receipt of the withdrawal communication, Customer Service will promptly provide the Customer with instructions on how to return the goods, which must be received by Scalzo within 10 days of authorization.
4.2. The right of withdrawal is subject to the following conditions:
a) the right applies to the product purchased in its entirety; withdrawal cannot be exercised on only part of the purchased product;
b) the purchased item must be intact and returned in its original packaging, complete in all parts;
c) shipping costs for returning the item are borne by the Customer;
d) shipment, until receipt is confirmed at the seller’s warehouse, is the full responsibility of the Customer;
e) in case of damage to the item during transport, Scalzo will notify the Customer (within 5 working days of receipt at its warehouse) to allow them to promptly file a claim against the chosen courier and obtain reimbursement of the item's value (if insured); in this case, the product will be made available to the Customer for return, simultaneously canceling the withdrawal request;
f) Scalzo is not responsible for damage, theft, or loss of goods returned via uninsured shipments;
g) upon arrival at the warehouse, the product will be inspected for any damage or tampering not caused by transport. If the original packaging and/or wrapping is damaged, Scalzo will withhold a percentage, not exceeding 10%, from the refund as a contribution to restoration costs.
4.3. Except for any restoration costs for confirmed damage to the original packaging, Scalzo will refund the amount already paid to the customer as soon as possible and in any case within 30 days from the withdrawal request, by reversing the amount charged to the Credit Card or by Bank Transfer. In the latter case, the customer must promptly provide the bank details for the refund (IBAN or ABI – CAB – Account holder of the invoice).
4.4. The right of withdrawal is completely forfeited if the product’s integrity (packaging and/or contents) is compromised, in cases where Scalzo verifies:
a) absence of the external packaging and/or original internal wrapping;
b) missing integral parts of the product;
c) damage to the product for reasons other than transport.
4.5. In case of forfeiture of the right of withdrawal, Scalzo will return the purchased goods to the sender, charging the shipping costs to them.

The Scalzo Family

It is the flavors of tradition and the love for authenticity that have always characterized the production of Azienda Scalzo, founded in 1973 by Giuseppe Scalzo. Initially, production was closely linked to the trade of mushrooms, both fresh and dried, but over time, the business grew and evolved, beginning the processing and marketing of forestry tools. The definitive turning point came in 1989, when the company shifted from commercial to artisanal, starting a new production focused on preserving both fruit and wild products, using traditional processing methods and treating raw materials exclusively with natural elements, without preservatives. All according to the unique recipes of Mrs. Carmelina, the founder’s wife and the current cornerstone of the company. Sugar, extra virgin olive oil, salt, and all elements useful for natural preservation are used in Scalzo products. Today, Azienda Scalzo produces a wide range of items, whose distribution is reserved for specialized stores throughout the national territory and beyond. And as in the best traditions, the company has managed to maintain a family character over time, assigning all members of the Scalzo family roles of responsibility. Scalzo products are all born in the Savuto Valley using traditional processing methods, treating raw materials exclusively with natural elements, without preservatives. This ensures that over time, the quality and authenticity characteristics that the company has pursued over the years are respected and maintained thanks to the love and dedication that have always been the foundation for the success of Scalzo’s typical products.
